Limited Manufacturer’s
Guarantee
Without prejudice to any claim the user (customer) may
have in relation to the dealer or retailer, the customer
shall be granted a limited manufacturer’s Guarantee
under the conditions set out below:
•
In the case of new devices and their components
exhibiting defects resulting from manufacturing
and/or material faults within 12 months of purchase,
BenQ shall, at its own option and free of charge,
either replace the device with another device
reflecting the current state of the art, or repair the
said device.
•
This Guarantee shall be invalid if the device defect is
attributable to improper treatment and/or failure to
comply with information contained in the user
manuals.
•
This Guarantee shall not apply to or extend to
services performed by the authorised dealer or the
customer themselves (e.g. installation,
configuration, software downloads). User manuals
and any software supplied on a separate data
medium shall be excluded from the Guarantee.
•
The purchase receipt, together with the date of
purchase, shall be required as evidence for invoking
the Guarantee.
•
Ownership of devices or components replaced by
and returned to BenQ shall vest in BenQ.
•
This Guarantee shall apply to new devices pur-
chased in the European Union and Turkey. For
Products sold in Turkey that are imported by BenQ
Mobile Telekomünikasyon ve Iletişim Hizmetleri
Ticaret Limited Şirketi, a separate importer’s warran-
ty is issued by BenQ Mobile Telekomünikasyon ve
Iletişim Hizmetleri Ticaret Limited Şirketi, Nida Kule,
Degirmen Sk. No 12 Kat 19, Kozyatagi/Istanbul.
•
Any other claims resulting out of or in connection
with the device shall be excluded from this
Guarantee. Nothing in this Guarantee shall attempt
to limit or exclude a Customers Statutory Rights, nor
the manufacturer’s liability for death or personal
injury resulting from its negligence.
•
The duration of the Guarantee shall be extended by
the time period used for services rendered under the
terms of the Guarantee.
•
Insofar as no Guarantee default exists, BenQ
reserves the right to charge the customer for
replacement or repair.
•
The above provisions do not imply a change in the
burden of proof to the detriment of the customer.

Lisans Sözleşmesi
İşbu Lisans Sözleşmesi ("Sözleşme") tarafınız ve
BenQ Mobile GmbH & Co. OHG ("BenQ") arasındadır.
Sözleşme Tarafınıza, aşağıda Madde 1'de belirtilen
Lisanslı Yazılım'ı kullanma yetkisini vermektedir. Bu
Lisanslı Yazılım telefonunuza yüklenmiş durumda, CD-
ROM'da kayıtlı, Tarafınıza elektronik posta veya yayın
olarak gönderilmiş, BenQ Web sayfalarından veya
sunucularından veya herhangi bir başka kaynaktan,
aşağıda belirtilen koşullar altında yüklenmiş olabilir.
Telefonunuzu kullanmadan önce bu sözleşmeyi
dikkatle okuyun. Telefonunuzu kullanmakla veya
Lisanslı Yazılım'ı kurmak, kopyalamak ve/veya
kullanmakla, Sözleşme'yi okuduğunuzu, anladığınızı
ve aşağıda belirtilen tüm koşullara bağlı kalacağınızı
kabul etmiş olursunuz. Bununla birlikte, BenQ veya
BenQ'in herhangi bir Lisans sağlayıcısı (Lisans
Sağlayıcı) bu Sözleşme'de belirtilen haklarını
kullanmak için yasal veya diğer süreçlere başvurmak
zorunda kaldığında, BenQ ve/veya Lisans Sağlayıcısı,
vadesi gelmiş her tür ek tutarların yanı sıra makul
avukatlık ücretlerini, masrafları ve giderleri
Tarafınızdan tazmin etme hakkına sahiptir. Eğer bu
Sözleşme'nin tüm koşullarını kabul etmiyorsanız,
Lisanslı Yazılım'ı kurmayın veya kullanmayın. Bu
Sözleşme, Lisanslı Yazılım'a ilişkin her tür güncelleme,
sürüm, düzeltme veya yükseltme için de geçerlidir.

LİSANSLI YAZILIM. Bu Sözleşme'de kullanıldığı
biçimde "Lisanslı Yazılım" şu anlamları içerir:
telefonunuzdaki tüm yazılımlar; yayın olarak
dağıtılmış, BenQ Web sayfalarından veya
sunucularından veya herhangi bir diğer kaynaktan
yüklenmiş BenQ’e veya üçüncü taraflara ait ilgili her tür
yazılım ve yükseltmeler, değiştirilmiş sürümler,
güncellemeler, eklemeler ve Lisanslı Yazılım'ın
kopyaları dahil olmak üzere, disk/disklerin, CD-
ROM/CD-ROM'ların, elektronik posta ve dosya
eklerinin veya bu Sözleşme'nin beraberinde sunulan
herhangi bir diğer ortamın tüm içerikleri.
